The large majority of international adoptions are arranged through adoption agencies that are specifically qualified and licensed to do international adoptions. The adoption is usually finalized in the country where the child was born. This adoption, however, does not grant immigration approval. The adoptive parents will have to initiate a separate application for immigration status.
Readoption In The United States
It is strongly recommended that parents who have adopted a child in another country readopt that child in their home state. Virginia’s process for readoption involves submitting a petition to the Circuit Court and the filing of a report by the agency that facilitated the adoption. Once a Virginia Final Order of Adoption is obtained, the parents may apply for a Certificate of Foreign Birth that looks exactly like a Virginia birth certificate and can be used for all of the same purposes.
